Abstrakt

The citizens of Bosnia are currently trapped in a Constitution that offers only tribalistic decision-making mechanisms for getting rid of its tribalistic structures

Even if equality and non-discrimination are enshrined in a constitution, they represent principles that go beyond the respective state of actual realization at a given time, as they call for an ongoing correction of shortcomings. Gender equality and women’s rights, for instance, call for a permanent refinement of legal standards that touch on many dimensions of life like family law, labour law, equal payment for work, education, political participation, etc.

In time of promises for constitutional changes, implementation of Sejdić-Finci verdict, readiness for EU membership, we talked with Prof. Dr. Stefan Hammer on very basic constitutional principles (to recall what constitutionalism, democracy and the constitution are), how and why Constitution of BiH is sui generis and what that mean for BiH citizens, but also we asked for ‘foretelling the future’ – can we expect (and what kind) the constitutional reform and is it reasonable to hope for fair and just Constitution of BiH.
